SOPOs can only be imposed "for the purpose of protecting the public or any particular members of the public from serious sexual harm from the defendant".
It has already been ruled, in the High Court, that a person possessing low-level indecent images is not a serious danger to the public. If the High Court judge believed that such a defendant was at risk of committing acts which would cause serious sexual harm, said judge would not have ruled that the defendant was not a serious danger to the public.
An Appeal Court also overturned the IPP against a PIE member who had possessed level 5 images (sadism or bestiality), because in the opinion of the judge, said PIE member did not pose a serious danger to the public.
Despite the rulings related to IPPs, applications for SOPOs against people convicted of possessing indecent images are still accepted. The Crown Court judges are blatantly ignoring the rulings of their superiors and they are not being challenged. If anyone here is subject to a SOPO for a CP offence, you really should consider taking your case to court.
