If they would prosecute a hebe for possessing this one; they'd conversely have to prosecute the journalists for taking it and the magazines for publishing it.

Since the latter is just not gonna happen, neither will the first.

Otoh, I don't exactly like this outcome either - not just because of the two categories of "perpetrators": also because of the two categories of "victims". If it wasn't Jamie Lynn, but a random unknown mother who happened to be or look under Magic Number, then you can be sure it would be prosecuted for production, distribution and possession alike.
