I'm having trouble coming up with a situation where this would be tested. Possession is illegal, so if they kept such images after they were made illegal it's still a crime. Someone simply saying they used to possess such images might be used as grounds to search their house, but if they actually got rid of them a search would not provide any evidence for prosecution (though they might face enduring public contempt). I know I've heard that material produced before a specific date is exempt from the laws requiring documentation of 18+ status, but that's not exactly what you're asking about.
