Aggravated sexual battery was that I held her while we were in bed. Of course, they didn't mention that she held me, too. Battery is a criminal offense involving unlawful physical contact, distinct from assault which is the fear of such contact. The penalty for such a charge is 10 to 20 years in state prison. This is because most people think of battery as the "Battered Wife" image which justifies such a prison term for being sensual with each other. Assault, too, is misleading. Most people think of a military assault on some obscure military objective with lots of shooting and death. In Law, telling someone that you will punch their nose is, legally, an assault.
Forcible sodomy was that I kissed her "there" to give her sexual pleasure. No, there was no penis up the ass. That's what people think, though. So the penalty for such a charge is 20 to life in prison.
What someone is charged with often bears no relation to what actually occurred and why it occurred. Law often does not make sense.
The judge, in sentencing me was quite bored when he began to read his speech before he pronounced sentence on me. In the midst of his first sentence, news reporters walked into the room in anticipation of the murder trial scheduled after mine. The judges demeanor suddenly changed into a loud ranting hatred of everything about me, what I did, and etc. He threw punishment at me: "TEN YEARS FOR.... yada yada yada." He was trying to physically hit me with words. Added all up, he had sentenced me to the minimum the law would allow; most of the sentences were to be served concurrently with one of the other sentences. What sounded like a whole bucketful of life sentences ended up sitting me behind bars for less than 20 years. The judge knew that my partner and I only were sensual with each other and that I had pleasured her. She was never physically hurt nor did she ever pleasure me. Yet the LAW painted a completely different picture, eh?
Words. Go figure...
Regarding this post and every post I write about myself describing my past, be advised that I was tried, convicted, sentenced to a very long time in prison, and I served the complete sentence. Be further advised that I am no longer practicing illegal activities today and that I refrain from doing so by my own choice, not from fear of legal entanglements or society's outrage. I remain crime free because I choose to.
