But, no one under the age of twelve can be criminally charged in Canada under the presumption that no one under twelve has the mental capacity to know what they're doing (they don't have the state of mind to actually commit a crime). Whether or not it's true that no one under twelve and everyone above twelve has the mental presence to commit a crime (obviously not trueage is always arbitrary), I support the notion that a lot of kids (especially well under 12) are not capable of committing a crime because they do not have the mental presence. This kid obviously wasn't committing a crime.
I'm pretty sure this originated in the United Kingdoms, so I assumed there would be something similar in the US.
I do find it funny though that at 12 years old every person is now capable of committing murder, but not of having sex.
