Depends on the details - but yes, it is a possibility.
A perverse incentive in family approval is that families denying approval to the relationship, yet a consensual relationship taking place, ends up being adultery because there is no marriage planned later on. Pre-marital sex is not necessarily adultery, otoh, when there is an intention to marry.

That's cultural. In paper, both are equally to be punished.

Only in rape. Actual rape. As in, she refused, she gets hurt. He pays what is de facto a lifelong pension to her, and although he is not considered as ever having married her, marriage regulations against marriageability with in-laws apply, meaning he cannot marry her, her sisters, her mother, her daughters, and any other direct ancestor or descendant.

Btw, I do love the idea of rape leading to the rapist paying a lifelong pension. Much better than a registry. Jail might still be desirable for many rapists, sure, but lifelong pension is a way better penalty than registration.
