Jail makes the rapist unable to REALLY "pay his debt to society " ( I dont think that "correctional facilities " really "correct" anyones behavior, the only way to keep them from reoffending is to keep them locked up forever or kill people and that wouldnt work too well .Rehabilitation works in different ways )and punishing them in that manner just makes people feel safe and instills a sense of Schadenfreude in their punishment. Making someone pay the victim money as a settlement or rather verdict is better and really makes restitution ...restitution .No sex offenders list either, because , how is an unemployed ,homeless person able to pay the rape victim support check if he doesn't have any money?And no castration for the offender either , that's just too creepy and cruel and unusual punishments brings you to the level of the criminal .Also , an innocent person who was framed for rape by the girl or the court could survive paying a support check but couldn't survive being castrated .
Any verdict and support payment should fit accordingly to the rapists ability to pay , sure a strict and tough "fine" would be preferable ,but if the criminal falls into poverty ,how will he continue to pay the settlement ?Rich sociopaths might think that its a expensive but affordable pastime to rape girls and just settle with them if caught ,but their share of the penalty would be just as severe as the middle class schmoes . I don't think that the offender would re-offend if he were slammed with a hefty monthly support bill and if he did , and was caught ,guess what ? Hed have ANOTHER girl to support. Also , if the person could not pay the support check , the y could be arrested or something to punish them .
