I was charged with and plead guilty to Aggravated Sexual Battery and Forcible Sodomy. These sound so horrible, so heinous, so violent, eh?

The legal definition of "battery" simply means illegal contact between persons. For example, if I were to point at your chest and angrily say things to you so that you knew I was not being friendly, this is illegal and called verbal assault. However, should I touch you while not being friendly, this is also illegal and called battery. "Assault" being a threatening confrontation, battery being an illegal touch. "Aggravated" something means that there are other things to consider along with the illegal acts. For example, if I am in a position of authority and I yell and threaten you, this would be aggravated assault. "Forcible" something means that force was used.

Well, here's what I did: I took her to the shower and gave her a soapy, full and complete body massage, touching "down there" occasionally, but never being invasive. This is where the Aggravated Sexual Battery came from. Occasionally, I performed oral sex on her (never her on me) until she achieved orgasm. This is where the Forcible Sodomy came from. Perhaps it could be said that she could not consent because she was a child of mine and only 6. But we were "involved" for years and she knew she could say "no" any time she wished because I often told her she could. Occasionally she did and I respected her wishes. Also, occasionally, she would ask me for an encounter.

Never once did anything occur that could be construed as "the child is suffering." Never once was there any "force" used nor any, "Do this or I'll ..." etc.

True, I was "Dad", and she wanted to please me so she would do what I asked. So that could be thought of as non-consensual. But what is the difference between her letting me brush her hair and her letting me bring her to orgasm? I mean, regarding consent.

One of the first times I performed oral sex on her, I was wondering if, perhaps, she found it uncomfortable. So I stopped only to be gently but firmly directed back to my previous activity. Later, I would ask, "Do you want me to stop?" The answer was always, "No."

You cannot make judgments about something or someone simply by what the government charges in its jurisprudence.

Finally in a sexual encounter with a youngster, what difference is there in a "blood daughter" living with you and a non-relative living with you? A little girl is a little girl.


Regarding this post and every post I write about myself describing my past, be advised that I was tried, convicted, sentenced to a very long time in prison, and I served the complete sentence. Be further advised that I am no longer practicing illegal activities today and that I refrain from doing so by my own choice, not from fear of legal entanglements or society's outrage. I remain crime free because I choose to.
