Sigh. Whether it was right or wrong, moral or immoral, consensual or nonconsensual, pleasing or disgusting, enjoyable or abusive, et cetera, et cetera, et cetera, had nothing to do with whether or not it can be considered art. Whether or not it's considered art, however, has nothing to do with whether or not the act was justified, or is defensible (which doesn't appear to be the case), either. I think you may be getting those two concepts confused. "Art" is not a word that automatically makes something reprehensible acceptable purely by way of being (or being called) "art".
