To add one reflection:

Not in all cases. Cause if the minor is having sex with a younger minor, he or she is suddenly capable of making decisions on sex and is thus a sex offender, who should be mature enough to understand that such acts are extremely harmful. Suddenly the child is not regarded incapable of understanding sexual acts.

So the child is now a registered sex offender, not being allowed to live in the same neighborhood as their friends. An everyone on school needs to be warned about this child being capable of understanding something his classmates are too immature to understand.

A child is not always incapable of making decisions on sex. Sometimes it's a sex monster resposible of horrible sexual violence. Like being affectionately with a loved one.
