I know that under UK law, they charge you with "making" an image, but under US law, I don't think mere possessors are charged with production. Distribution possibly, like with P2P as you mentioned. But let's say that a guy gets charged for possession and part of the material he possessed was Vicky, who is easily identifiable and a professional restitution victim and testifier for the prosecution. They've already established that the producer is John Kenneth Freeman, so there's no way that they can charge some random guy with production. Most likely simple possession, possibly distribution, but not production. Of course, I'm basing this mostly on US law. Your local laws may vary.
