Disregarding all the crap about kids and sex for obvious reasons, the problem is that it doesn't work like that. The public peace is a real thing, not just some bullshit some lawyer pulled out of his ass. Recognizing an individual's right to be an individual versus protecting the public trust is a balancing act, and a murky one, as all complex moral situations are.

Nevertheless, no one in a society should have to live in mortal fear of their lives, and when there's a violent person living in your neighborhood, even if their violence thus far is only focused on a spouse who clearly didn't consent to it at the time but always winds up justifying it ex post facto, then society has a right to intervene to some degree. Like I said, where that intervention should stop is a murky question, but generally society has a way of self-regulating toward the mean anyway. That can't really be said of individuals because they are all different; however, there are often some good statistics we can reference, and what we know about violent abusers is that their violence rarely stops at their spouse.

Therefore, it is proper that society gets involved to some extent, if only to separate an abuse victim from their abuser long enough to determine if the victim is taking the side of their abuser out of fear of being killed or if they really don't mind getting punched in the face or knocked out. There's only so much we can do, yes, but that doesn't mean there's nothing we can do.
