The main problem with prosecuting a work based on whether it's "suggestive" is that it ultimately depends upon what side of the bed the Judge woke up on and whether the prosecutor is up for reelection.

Suggestive really ends up translated as subjective for all practical purposes. And like Ron's instinct, is so "self-evident" as to be held above the level of questioning.

But once one begins to try to look at it from a content-driven point of view, rather than as an ephemeral aesthetic, its hard not to see the "objectionable" elements as central to a lot of cherished imagery.

The "lacking artistic merit" card has been played often in such aesthetic prosecution. But it pretty much goes without saying that the creator has to prove that they and their audience are Nons in order to defend a work on the grounds of artistic expression; something we would not expect when obscenity charges are brought against telio-hetero content.

"Your Honor, clearly Lady Chatterly's Lover was written for an audience of Homosexuals; so it's ludicrous to suggest that they would be titillated by its content. They must be reading it for its artistic merits. The Defense rests."
