However, it IS true that the harsher the sentences are for stupid things, like this, the less the deterrence factor is credible for larger offences, like forced and violent contact.

There are of course many ways to express it that are less absurd. For instance, if drunk driving got you death penalty automatically, then instead of drinking four glasses and stopping (which would make you give a positive to the police, but wouldn't make your driving erratic, therefore making the offence less detectable), once you arrived to the fourth glass you would as well arrive to the fourth bottle, because the penalty if caught by the police would not increase.
