I would not need to defend myself. She would be the one attempting to defend her actions in court - and facing the probability of very heavy costs when she failed to successfully do so.

The best form of defence is attack.

That, of course, is in reply to the question of what 'I' would do. For other people much would depend on their own personal circumstances and on her circumstances.
