Actually, that might've been a factor in the judge's decision to throw out that charge. It is a fact that attractive people are less likely to be convicted for crimes than are ugly people. Sad but true. And it's true across the board for all types of crimes, with one exception: crimes in which the defendant's attractiveness was used to his or her advantage in the commission of their crimes (e.g. con men).
