I agree. Seems more like an example of doublespeak to me than outright stupidity or ignorance. They don't just hand out law degrees on the back of Cracker Jack boxes, ya know ;). And as we've already established, he may have a lot to gain by billing either/both the prosecution/defense for working long hours on confusing case law.
