In 1991, female toplessness as an indecent act was challenged in a small city in Ontario by a woman who removed her shirt and was charged with indecency. Police stated that they acted following a complaint from another woman who was upset that one of her children had seen the topless woman.

The topless woman stated she did it because men were doing it and she wanted to draw attention to the double standard. She was found guilty and fined $75. It was overturned by the Ontario Court of Appeal. Today, it is legal for females to go topless in the province. The act of being topless is not in itself a sexual act or indecent, therefore, legal. So says the Province of Ontario.

Despite this, women still faced discrimination in public facilities. In 1997, a woman was charged with trespassing for swimming topless in a nearby small city, but the charges were dropped. She was then charged again, and also this was dropped by the crown, so the City initiated its own prosecution. Although this too was dropped, a bylaw specifically prohibiting top-free swimming was passed. Eventually her efforts led to a new bylaw allowing top-free swimming.

In Toronto in 2011, a Go Topless Day rally was refused a permit to meet in a park, so they marched freely down the streets... with a police escort.

It should be noted that there is Hanlan's Point Beach, a public beach situated on Hanlan's Point in the Toronto Islands near Toronto, on the shore of Lake Ontario. Within vision of all those overlooking bank towers at the water's edge is a one kilometre-long part of the beach officially recognized by the city in 2002 as being clothing optional. In the decades prior to this, it was an infrequent target of police crackdowns for nude sunbathing. Its official legal status then resulted in a distinct increase in ferry traffic, and it appears to be a profitable component of public- and private-sector advertising campaigns, since it draws visitors to Toronto. Police and park officials now work in partnership with the beachgoers to maintain the friendly atmosphere.

Of course, being a sailor, I occasionally sail past the area when I visit the Toronto Islands. Although the beach is mostly frequented by nude males, there are the occasional nude females. Occasionally, too, are complete nude families.

Even though it is completely legal to do so, you never see a topless woman walking the streets or shopping malls... topless. That, my friends, is the pressure of Society upon the individual. Whether or not it makes any sense.
