I propose a simple solution for mandatory reporting laws. When it comes to child endangerment due to involving minors in sexual acts the MHP shouldn't ask. The MAP shouldn't tell. It goes beyond that. No matter what the MAP tells the MHP the MHP should never assume that sexual encounters involving minor children has happened and should never ask about illegal sexual encounters involving minor children. Unless the MAP describes something illegal of a sexual nature was done with a child the MHP shall always assume nothing illegal has happened.
I don't like the other mandatory reporting laws either. If an MHP wants to provide mental health services to a MAP a policy of Don't Ask Don't Tell should be mandatory. |
