"have sex" carries connotations of certain kinds of acts that 'sexual touching' doesn't necessary require.

the curiosity of a young child can easily lead to exploration of an adults body, genitals included. the child might also be proactive in exhibiting his or her own genitals to the adult and inviting touch.

many 4 or 6 year olds will quite naturally initiate this kind of behaviour.

the adult is faced with two options. discourage the behaviour, at the risk of discouraging a fundamentally healthy attitude and impulse, or go along with it, at the risk of going to jail and exposing the child to the hostile and fearful reactions from society.

i think many legal problems arise well before anybody is 'having sex' (mutual masturbation, oral sex, penetration). i also think the law oversteps its mandate in interfering with these natural expressions of love and trust.
