Nobody is ignoring the injustice of the justice system in this debate. And if anyone's argument could lead to foolhardy risks they are yours which repeatedly focus on CP being as bad as the authorities claim in its content rather than being as innocuous as what you dismiss but which is drastically punished nonetheless.

As Falkvinge pointed out, the Authorities repeatedly confront those who are baffled by their arrests because the content involved nothing necessarily sexual, abusive ( or even necessarily involving real children. ) Getting thrown away for cartoons, nude beach pics or other such CP seems incredible when the authorities increasingly hype that what they are seizing is vile images of sexual abuse.

But at least the rest of us aren't dismissing the stupidity of the law, or the serious consequences over looking at very tame images.

Though again, I'm sure your thesis requires you do dismiss its relevance to arguments about CP despite its legal status as CP.

Sorry. "Revictimization" legal theory applies to all "Child Sexual Abuse Imagery" regardless of whether the abusive act was taking a shower unclothed. Your desire that the theory makes sense doesn't change its application. And yes, all testimony is irrelevant to the theory. It ought not be. But it is.

The law is concerned with the image. Not with the act the image recorded, nor with the opinions of those involved in the act the image recorded; except insofar as they might contribute to an increased sentence. Any opinion contributing towards a decreased sentence will be dismissed as a product of "grooming." ( Unless it is actual evidence that the crime never occurred in the first place. )
