Remember that on P2P, everyone that is a possessor is also a distributor, by its very nature.
And with any form of transmission via electronic devices (computers mainly, but also cellphones, digital cameras, tablets, and all the possible means of storage associated) every copy constitutes production. Downloading constitutes production because it makes a copy. Online viewing, barring streaming, constitutes production because it makes a copy, albeit temporary.
So the language is misleading. Anyone will be charged with production, and everyone caught via P2P will be charged with distribution.
