There seldom is a clear cut case for many situations but some we all tend to agree on which perhaps will form the basic human rights that we would wish for all to have.
It's exactly the opposite way. Human rights cannot be formed by consensus, because in that case they are not inherent, but conventional.
Markaba formulates this position better than I do, actually, because he holds that human rights are conventional. I don't.
