The Peter MacKay law which makes it legal to sell but not to buy sexual favours is inherently insane - yet it is the law of Canada. It means that all of a woman's customers are committing a criminal offence for buying services that are legal for her to sell and upon which the government is happy to collect both GST and income tax. This law discriminates againt both women (because it regards them always as victims) and men because it regards them always as criminal perpetrators regardless of the circumstances.

The activities related to sex work that are prohibited by law include operating a premises (sexual services establishment or brothel) where such activities take place, being found in such an establishment, procuring for such purposes, and communicating such services (soliciting) in a public place, making it difficult to engage in prostitution without breaking any law. Automobiles are considered public spaces if they can be seen. On the other hand, working as an independent sex worker and private communication for such purposes (telephone, internet, e-mail, etc.) is legal. This ambivalence can cause confusion leading to one judge referring to the laws as 'Alice-in-Wonderland' and the Chief Justice of the Supreme Court referred to the situation as "bizarre".

And then...

The age of consent is the age at which a young person can legally agree to sexual activity. Age of consent laws apply to all forms of sexual activity, ranging from kissing and fondling to sexual intercourse.

The age of consent to sexual activity is 16 years. In some cases, the age of consent is higher (for example, when there is a relationship of trust, authority or dependency).

In other words, a person must be at least 16 years old to be able to legally agree to sexual activity.

A 14 or 15 year old can consent to sexual activity as long as the partner is less than five years older and there is no relationship of trust, authority or dependency or any other exploitation of the young person. This means that if the partner is 5 years or older than the 14 or 15 year old, any sexual activity is a criminal offence.

There is also a "close in age" exception for 12 and 13 year olds. A 12 or 13 year old can consent to sexual activity with a partner as long as the partner is less than two years older and there is no relationship of trust, authority or dependency or any other exploitation of the young person. This means that if the partner is 2 years or older than the 12 or 13 year old, any sexual activity is a criminal offence.

A 14 year old girl can legally kiss a 19 year old boy. If he is 20, he goes to jail.
A 12 year old girl can legally kiss a 14 year old boy. If he is 15, he goes to jail.

Jail for kissing.
