So, you are dividing potential love objects of preteen girls into three groups:
1) Outcasts previously convicted of rape. Preteen girls are not free to enter into sexual relationships with those. You might be confronted by a preteen girl telling "Yes, I know what he did. I still want to have sex with him. He cannot rape me for I plan to consent!" And yet your answer would be "Does not matter - you are not free to love him!"
2) Ordinary masses - see them defined by contrast with group 3)
3) Privileged paedophiles

Note that only privileged paedophiles can give a girl "legal assurances of respectful interaction". With anyone else, such assurances are deliberately denied. "Don´t have sex with him, the moment he changes his mind, you are screwed!".

-"No! Minors are not allowed to marry!"
-"But he will sit the certified paedophile tests specially for my sake!"
-"No! The tests are separate from existence of any specific relationship and having a specific relationship disqualifies him!"
